Alleged Violations against Nations Recovery Center, Inc.
According to PACER, on or about October 14, 2013, Nations Recovery Center, Inc. mailed a debt collection letter to a Wisconsin resident. The letter, which appeared to be computer-generated, included the statement “This collection agency is licensed by the Division of Banking, P.O. Box 7876, Madison, Wisconsin 53707.”
The plaintiff took this to mean that Nations Recovery Center, Inc. held a Wisconsin Collection Agency License, but this was not the case. A representative of the Division of Banking confirmed to the plaintiff’s attorney that the company did not currently hold a Wisconsin Collection Agency License and did not hold such a license when the letter was mailed.
Feeling harassed by Nations Recovery Center, Inc., the plaintiff hired a consumer attorney and filed a class action lawsuit against the company for allegedly violating the FDCPA by using false, deceptive, and misleading means to collect a debt.
The matter was later dismissed.
