Jenny Simpson vs. LTS Management Services, LLC**
According to Pacer, on or around July 13, 2006, Alabama resident Jenny Simpson borrowed $300 from LTS Management Services, LLC, which was doing business as Xpress Cash/DMS Marketing. Ms. Simpson later alleged that from July 18, 2006 through December 26, 2006, LTS Management Services, LLC, through a plethora of companies, deducted $1800 in fees and payments from her checking account.
During this time, she attempted to contact the company to find out why they had taken so much money, but was unable to directly speak to anyone at LTS. She was then forced to close her checking account and was credited only a small portion of the money back.
On December 24, 2006 Ms. Simpson received a letter from ‘Liz Ellis’ with Xpress Cash/DMS Marketing stating her account was overdrawn in an attempt to collect the debt. This letter was allegedly followed by an abusive and harassing e-mail message from ‘Westbury Ventures’ that threatened to contact Ms. Simpson at her place of employment.
On January 30, 2007, she ordered Ms. Ellis and Westbury Ventures, DMS Marketing and LTS to stop communicating with her, but allegedly received several emails and at least three phone calls.
Feeling harassed by LTS Management Services, LLC, Ms. Simpson hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
