Kristina Huffman vs. AmerAssist A/R Solutions, Inc.*
According to PACER, on or around May 19, 2015, AmerAssist A/R Solutions, Inc. allegedly sent Colorado resident Kristina Huffman a debt collection letter that contained what she perceived to be false threats and harassing language.
The letter, which was later introduced as an exhibit, said in part, “Wouldn’t you prefer your record to reflect payment in full of this small balance, which is the first step toward restoring your credit standing.”
At the time Ms. Huffman received this letter this account was not being reported on her credit report. She also objected to another part of the letter, which read:
“It is urgent that you make payment in full or satisfactory payment arrangements so that we are not obligated to proceed with additional collection steps, which may cause needless time and expense.”
Feeling harassed by AmerAssist A/R Solutions, Inc., Ms. Huffman hired a consumer attorney and sued the firm for allegedly violating the FDCPA in the following ways:
- Engaging in harassing and abusive conduct
- Using false, deceptive or misleading means to collect a debt
- Using unfair or unconscionable means to collect a debt
- Threatening legal action that it could not take or was not intended to be taken
The matter was later dismissed.
