Your Rights Under the FDCPA

In 1977, Congress passed the Fair Debt Collection Practices Act to stop debt collectors whose actions were leading to marital breakdowns and personal bankruptcies. The FDCPA gives you certain legal protections and prohibits the following:

  • Failing to always identify themselves as debt collectors
  • Using profane or obscene language
  • Calling you before 8:00 a.m. and after 9:00 p.m.
  • Threatening to have you arrested
  • Refusing to validate the debt
  • Ignoring a written request to stop contacting you
  • Contacting you at work

Alleged Violations against Mintex, Inc.**

According to PACER, on or around May 16, 2012, Mintex, Inc. sent a letter to an Illinois consumer to collect a debt arising from unpaid utilities. He said that the letter implied that the debt was already being reported to the credit bureaus and that it was followed up by numerous calls by individuals who did not identify them as debt collectors. He added that some of these calls were made to his brother’s phone number.

Feeling harassed by Mintex, Inc., the consumer got advice from a consumer lawyer and filed suit against the agency for:

  • Calling his brother’s number and leaving personal information
  • Failing to identify the callers as debt collectors
  • Sending confusing collector letters

The matter was later dismissed.
