According to PACER, on or around December 2018, Diaz and Associates, Inc. allegedly tried to collect a defaulted payday loan by calling a Texas consumer at work and discussing the debt with a coworker. The caller allegedly stated that if the consumer did not contact them immediately, they would take him to court.

When the consumer called Diaz and Associates, Inc., a collector allegedly threatened to send an officer to serve him court papers. They also allegedly used abusive and threatening language such as, “don’t piss me off” and “you don’t want to piss me off.”

Feeling harassed by Diaz and Associates, Inc., the consumer took the company to court for:

  • Using abusive language
  • Discussing his debt with his coworker
  • Threatening him with baseless legal action

The matter was later settled.
