Are You Being Called By Duvera Billing Services?

Most debt collectors work on a commission basis, so they try to get you to pay the debt immediately. This means that they’re more likely to swear at you, threaten lawsuits, and ignore disputes. Not only is this conduct offensive, it’s also illegal.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, requires debt collectors to treat you with respect when contacting you about a debt. Collection actions like those listed below are illegal and can result in fines and license revocation.

● Calling at inconvenient times
● Ignoring a cease communications request
● Contacting you at work after being told to stop
● Re-aging an old debt
● Yelling and swearing
● Pretending to be members of law enforcement

Alleged Violations against Duvera Billing Services

According to PACER, in or around January 2016, Duvera Billing Services sent a collection letter to a California consumer. She advised the company that the account was not hers, that she was a victim of identity theft, and that she wanted the account removed from her credit report. However, when she checked her report the following March, the account was allegedly still being reported as valid.

Feeling harassed by Duvera Billing Services, the consumer filed a claim against the company for:

● Reporting inaccurate information to the credit bureaus
● Misrepresenting the legal status of the debt

The matter was later settled.
