Are You Being Called By Debt Buyers, Inc.*? Here’s What You Need to Know

Literally thousands of people across the country are pursued by collection agencies. They owe money on their credit cards, student loans, and other obligations but, due to financial setbacks, are no longer able to make even the minimum payments. Unfortunately, they are also harassed and abused by phone and letter. If this happens to you, be aware that you have rights that protect you from such mistreatment.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a consumer protection law that regulates what third party debt collectors may say and do while trying to collect a consumer debt. Examples of illegal activities include:

  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Telling you that you can be arrested for nonpayment of a debt
  • Ignoring a formal cease communication request
  • Failing or refusing to validate the debt
  • Calling you at work when your employer does not allow such calls
  • Using profane and obscene language

Alleged Violations against Debt Buyers, Inc.**

According to information on the PACER website, in or around late 2011, a representative of Debt Buyers, Inc. started calling a Nevada couple to collect a debt. They retained an attorney, who sent a letter to the agency representatives on October 18, 2011. Although counsel for the agency acknowledged the letter in November, on June 7, 2012, it allegedly sent another collection letter directly to the consumers.

Feeling harassed by Debt Buyers, Inc., the consumers acted on their rights and sued the company for contacting them directly when they were represented by an attorney regarding the debt.

The matter was later dismissed.
