Are You Being Called By CreditOne, LLC?*

Dealing with a collection agency is never pleasant, as you’re being asked to pay a debt you can’t afford due to financial challenges. If the debt collector assigned to your account is rude and aggressive, the situation can be intolerable.

Before you consider bankruptcy, be aware that legally, you don’t have to tolerate this type of treatment.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, provides you with valuable protections when dealing with a collection agency. You can tell them to stop contacting you, dispute a debt, and sue any company that uses these types of collection methods.

  • Using profane or obscene language
  • Calling you at work to embarrass you in front of your boss and co-workers
  • Demanding excessive service fees in addition to the original debt
  • Using an autodialer to call you
  • Calling before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Threatening action they cannot legally take or have no intention of taking

Alleged Violations against CreditOne, LLC

According to PACER, on or around April 16, 2014, CreditOne, LLC sent a collection letter to a Florida consumer seeking payment for a debt. It was followed by two more letters on July 8 and October 17.

All three letters stated that he had 30 days to dispute the debt, although more than 30 days had passed between each letter. The debt had also become time-barred on February 28, 2014.

Feeling harassed by CreditOne, LLC, the consumer hired a lawyer and sued the company for the following alleged FDCPA violations:

  • Trying to collect a time-barred debt
  • Using harassing and abusive means to collect a debt

The matter was later resolved.
