Are You Being Called By Emerald AR Systems?*

Being in debt is not an enjoyable position to be in, but it is common. Research suggests that people across the country are now in over $1 trillion worth of credit card debt.

Collection agencies have gone into overdrive to collect this money, many of them using illegal methods to coerce consumers to pay.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, applies strict limitations on what collection agencies can and cannot do when trying to collect money from you. Any debt collector who ignores the law and uses manipulative tactics like the following risk high fines and loss of their license.

  • Calling you at work when you’ve already told them that you can’t talk to them there
  • Calling your friends and relatives and telling them about your debt
  • Swearing at you over the phone
  • Pretending to be lawyers or federal agents
  • Trying to collect more than you really owe
  • Using an autodialer to call your phone daily, sometimes hourly

Alleged Violations against Emerald AR Systems

According to PACER, on or around April 5, 2012, Emerald AR Systems allegedly called the parents of a New York consumer and left a voice message advising her that they were trying to collect a debt from her.

This message, which was overheard by her parents and sister, caused her great embarrassment. She also claimed that she never received a debt validation letter within five days as required by law.

Feeling harassed by Emerald AR Systems, the consumer filed an FDCPA lawsuit against the agency, claiming that they had:

  • Revealing details of her debt to third parties
  • Failing to send a debt validation letter
  • Using harassing and abusive means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later dismissed.
