Alleged Violations against Lyon Collection Services, Inc.
According to PACER, on or about August 9, 2010, Lyon Collection Services, Inc. mailed a collection letter to a New Jersey consumer. It was followed by a second letter on September 14, which read, in part: “We sent you a first notice which included your rights under the Fair Debt Collection Practices Act. You still have time to exercise your rights.”
The consumer retained an attorney, who sent a cease and desist letter on May 18, 2011. A week later, Lyon Collection Services, Inc. responded by a fax which stated, in part, “Please review and contact the undersigned in order to arrange payment.”
The letter failed to disclose that the communication was from a debt collector.
Feeling harassed by Lyon Collection Services, Inc., the consumer engaged a consumer lawyer and sued the agency for the following alleged collection law violations:
- Using false, deceptive and misleading means to collect a debt
- Failing to identify itself as a debt collector in all communications
The matter was later settled.
