Are You Being Called By Alltran*? Here’s What You Need to Know

Money problems can strike anyone at any time. One day you have a well-paying job, the next you are laid off and struggling to make ends meet. When your debts go into arrears, the accounts may be turned over to a third-party collection agency. What you need to know is that these companies may attempt to collect a debt from you, but harassing you in the process is illegal.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) regulates how third-party collection agencies may communicate with consumers while trying to collect a debt. They must refrain from using deceptive or abusive tactics like those listed below:

  • Swearing, calling you names, and using profane language
  • Refusing to validate the debt and prove that they are authorized to collect it
  • Persisting in trying to collect a disputed debt
  • Failing to identify themselves during each communication as a debt collector
  • Calling you at work after being informed that the workplace does not allow non-business calls
  • Threatening action they are not in a position to legally take

Alleged Violations against Alltran

According to PACER**, on or about November 3, 2015, Alltran sent a collection letter to an Illinois resident. It appeared to state, in part, that interest would accumulate on the debt, causing the total to grow even though she had not entered into an agreement with the original creditor or the collection agency that late fees would apply to the debt.

Feeling harassed by Alltran, she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

The matter was later dismissed.
