Alleged Violations against National Enterprise Systems, Inc.
According to PACER, in March 2010 an Arkansas resident received a collection letter from National Enterprise Systems, Inc. The letter allegedly listed multiple accounts, did not identify the original creditor, and demanded payment according to a schedule that violated her dispute rights.
Later that day, the plaintiff received a call from a collector who identified himself as “Michael from NES.” When she said she had just gotten the letter and not yet had time to respond to it, he allegedly exclaimed, “No, ma’am! Listen! I’m explaining what’s going on because this is being signed off on today!” He added, “They put the recommendation that further action be filed against you.”
More calls allegedly followed, many of them made using an autodialer. When messages were left, they allegedly did not identify the caller as a debt collector seeking to collect a debt.
Feeling harassed by National Enterprise Systems, Inc., the plaintiff hired a consumer attorney and sued the agency for allegedly violating the FDCPA in the following ways:
- Using harassing and abusive means to collect a debt
- Using profane and obscene language
- Threatening action that could not legally be taken
