According to PACER, in or around early 2014, Avadanian & Adler, LLC began contacting Maryland resident Jason Schmitt about an alleged medical debt. He advised the collectors that he was disabled and surviving solely on his social security disability income. When he offered to make small monthly payments to stop further collection activity, they allegedly laughed at him, threatened to garnish his nonexistent wages, and repossess his car.
Mr. Schmitt also alleged that they used abusive language, calling him a “fu*king liar” and “guy in a tutu”, and even called his parents. One collector allegedly called his mother stupid and said that her son was stupid as well. Some calls even came after 9:00 p.m. at night.
Feeling harassed by Avadanian & Adler, LLC, the Hardeckis hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
- Using profane and abusive language
- Using harassing, oppressive, and abusive means to collect a debt
- Using unfair or unconscionable means to collect a debt
- Discussing the debt with uninvolved third parties
- Calling him outside of approved hours
