The letter, which was submitted as an exhibit, stated in part: “This collection agency is licensed by the Division of Banking, P.O. Box 7876, Madison, Wisconsin 53707.” However, a phone call to the Division of Banking allegedly confirmed that Nations Recovery Center of Georgia did not currently hold a Wisconsin Collection Agency License and did not hold such a license when it mailed the letter to her.

Feeling harassed by Nations Recovery Center of Georgia and believing that an identical letter had been sent to other Wisconsin residents, Ms. Aker hired a consumer attorney and sued the company for allegedly violating the FDCPA by using false, deceptive and misleading means to collect a debt.

The matter was later resolved.
