Are you being called by Nations Recovery Center of Georgia?* Here’s what you need to know.

If you miss a certain number of payments on your credit cards, student loans, or medical debt, your lenders or creditors will, in all likelihood, eventually turn the account over to a collection agency. These companies will use a wide range of scare tactics to get you to pay, hoping you will never realize that their actions break federal law.

Your Rights Under the FDCPA

Although the Fair Debt Collection Practices Act requires third party debt collectors to treat consumers with respect, hundreds of complaints are made to the Federal Trade Commission every year as the result of debt collectors using methods like those below.

  • Calling before 8:00 a.m. and after 9:00 p.m. in the consumer’s time zone
  • Talking to a person’s friends, neighbors, and coworkers about the debt
  • Telling someone that they have committed a crime like fraud by not paying the debt
  • Swearing, yelling, and using obscene language
  • Demanding amounts that are not supported by law or the original creditor agreement
  • Claiming to be law enforcement officers to scare you into paying

Alleged Violations against Nations Recovery Center of Georgia

Kimberly Aker, Individually and on Behalf of All Others Similarly Situated vs. Nations Recovery Center of Georgia*

According to PACER, on or about June 20, 2013, Nations Recovery Center of Georgia allegedly sent a collection letter to Wisconsin resident Kimberly Aker. The letter, which was submitted as an exhibit, stated in part: “This collection agency is licensed by the Division of Banking, P.O. Box 7876, Madison, Wisconsin 53707.” However, a phone call to the Division of Banking allegedly confirmed that Nations Recovery Center of Georgia did not currently hold a Wisconsin Collection Agency License and did not hold such a license when it mailed the letter to her.

Feeling harassed by Nations Recovery Center of Georgia and believing that an identical letter had been sent to other Wisconsin residents, Ms. Aker hired a consumer attorney and sued the company for allegedly violating the FDCPA by using false, deceptive and misleading means to collect a debt.

The matter was later resolved.
