Are you being called by Gila LLC?* Here’s what you need to know.
People can run into financial problems often through no fault of their own. The unfortunate reality is that debt collectors have little interest in what caused your situation: they simply want you to pay, and many of them lack both compassion and professionalism in their approach. If this happens to you, remember that mistreating indebted consumers is not only unethical, it’s illegal.
Your Rights Under the FDCPA
The Fair Debt Collection Practices Act (FDCPA), which was passed in September 1977, has firmly established guidelines intended to keep third-party debt collectors from harassing consumers. Prohibited actions include:
- Swearing, yelling, and calling you names
- Telling your friends, neighbors, and co-workers that you owe money
- Leaving voice messages that do not identify the collector and the purpose of their call
- Maliciously reporting false information to the credit bureaus
- Demanding outrageous amounts that exceed the amount of the original debt
- Threatening action they cannot legally take or have no intention of taking

Alleged Violations against Gila LLC
According to PACER, in November 2015 a Florida resident checked his credit report and saw that Gila LLC had reported a debt he allegedly incurred in July 2010. On December 1 he called the agency to dispute the debt and request verification. When he finally got a letter, it allegedly did not identify the agency and a balance of $0.00 had been crossed out and replaced with “collection fee: $128.19” and “total due: $582.69”.
Feeling harassed by Gila LLC, he hired a consumer attorney and sued the company for allegedly violating the FDCPA by misrepresenting the character, amount, or legal status of the debt.
The matter was later settled.
