Are You Being Called By POM Recoveries, Inc.?*

Are you receiving calls and letters from a debt collector? You’re not alone: millions of people across the country have some form of consumer debt in collections, with the average amount being $5,000. While trying to collect the debt is legal, harassing you to get you to pay is not. If a collection agency treats you in this manner, call an attorney.

Your Rights Under the FDCPA

Debt collectors can often prey on debtors unaware of their rights. The Fair Debt Collection Practices Act, or FDCPA prohibits third-party debt collectors from using deceptive and unethical collection tactics like the following:

  • Using profane or obscene language

  • Using the phone to harass you

  • Talking to your friends and family about your debt

  • Contacting you directly even after you’ve hired an attorney to represent you in the matter

  • Calling you repeatedly and leaving vague messages that do not identify their company or purpose

  • Threatening to ruin your credit if you don’t pay

Alleged Violations against POM Recoveries, Inc,

According to PACER, on or around February 9, 2016, POM Recoveries, Inc. began trying to collect a debt from a New York resident. On February 26 a collector who identified himself as ‘Clint Georges’ called and asked him to verify his account information.

When he asserted that he disagreed with the debt and asked whether he can dispute it, Mr. Georges replied, “On what behalf?” Unsure about his rights, he requested more information but later claimed that what he got was inconsistent.

Feeling harassed by POM Recoveries, Inc,, he hired a consumer attorney and sued the company for allegedly violating the FDCPA by using false, deceptive, and misleading means to collect a debt.

The matter was later settled.

I have 2 voice messages so far from POM by the SAME person each time they used a different name to identify themselves. The message is extremely mumbled and vague and also does not state the reason for the call. Is 2 times enough to file a claim?
