Are You Being Called By Zeelandia Capital, Inc.?*

Not too long ago, debt collectors could legally intimidate and harass consumers. Now you have rights that protect you from being threatened, bullied, and mistreated. If a debt collector makes your life miserable because you can’t afford to pay, a consumer lawyer can help you stop the unwanted calls and letters.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) provides indebted consumers with certain rights and protections. Once it was enacted in 1978, it prohibited third-party collection agencies from trying to collect money by:

  • Using profane and obscene language
  • Calling you at work when your employer does not allow such calls
  • Pretending to be police officers or federal agents
  • Threatening legal actions that they are not in a position to take
  • Refusing to prove that a debt is valid and they are allowed to collect it
  • Using an autodialer to call your phone nonstop

Alleged Violations against Zeelandia Capital, Inc.

According to PACER, on or around April 27, 2015, Zeelandia Capital, Inc. allegedly called an Illinois consumer to collect a debt. She insisted that the debt was included in a still-active Chapter 13 bankruptcy filing, but the representative allegedly told her that her bankruptcy case had been dismissed and continued trying to collect from her despite the fact that she was represented by an attorney.

Feeling harassed by Zeelandia Capital, Inc., she sued the company for allegedly violating her rights in the following ways:

  • Contacting her directly when she had an attorney
  • Demanding payment for a debt it could not legally collect

The matter was later dismissed.
