Are You Being Called By World Omni Financial Corp.?*

Debt collectors have a bad reputation for harassing debtors, sometimes over accounts they don’t legally owe. If you’re being chased by a collection agency that embarrasses you and makes your life miserable, don’t assume that there’s nothing you can do.

There actually are ways to stop the bullying that don’t involve paying the debt.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, protects indebted consumers when third-party debt collectors become too zealous. Its regulations prohibit the use of methods like the following to coerce you into paying.

  • Cursing and calling you names
  • Calling you at an inconvenient time, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Telling your friends, neighbors and co-workers that you owe money and they are trying to collect it from you
  • Telling you that you have committed a crime and will be arrested if you don’t pay
  • Failing or refusing to identify themselves as debt collectors in every communication
  • Reporting false information to the credit bureaus

Feeling harassed by World Omni Financial Corp., she hired a consumer attorney and sued the company for allegedly violating the FDCPA by reporting inaccurate information to the credit bureaus.
