According to PACER, on or around October 2, 2015 Williams, Alexander & Associates, Inc. sent a collection letter to a New Jersey consumer. It included the following statement:

”However we do and will utilize whatever means necessary and permissible by law to protect our client’s interests. In addition, we are a credit reporting source and we forward all valid debt information to the national credit bureaus.”

The consumer felt that this language overshadowed his 30-day dispute rights. In addition, the overdue amount, which was $195.95 had a collection cost of $93.58 added, which is roughly 48% of the total debt.

Feeling harassed by Williams, Alexander & Associates, Inc., he hired a consumer lawyer and sued the agency for:

  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Overshadowing his dispute rights

The matter was later dismissed.
