According to PACER, on or about February 13, 2017, Waypoint Resource Group, LLC sent a collection letter to a Virginia consumer. It stated, in part:

If you do not satisfy the terms and conditions of this settlement agreement, accrued interest or collection costs that occur during this time may be added to the current total balance indicated on this notice.

Because your account may accrue interest, late charges and other charges which vary from day to day, the amount required to pay your account in full on the day we receive your payment may be greater than the amount stated here.

The consumer knew that during the collection phase the balance would not vary, and felt that this language was intended to coerce him into making payment when in reality there would be no additional fees added.

Feeling harassed by Waypoint Resource Group, LLC, the consumer hired a lawyer and sued the company for allegedly violating his rights by:

  • Using false, deceptive, and misleading means to collect a debt
  • Failing to send a debt validation letter

The matter was later dismissed.
