Alleged Violations against Waterman Financial Group, LLC
According to PACER, in or around February 2017, Waterman Financial Group, LLC began to call an Illinois consumer to collect a debt. He alleged that each time he answered the phone, he heard a recorded message followed by a noticeable pause, before a live representative began to speak.
The collectors allegedly told him he owed a debt to his bank, but he was unaware of any debt and even called his bank to confirm. When the consumer told them to stop calling, they allegedly disregarded the request.
He claimed that they also left confusing voice messages on his cell phone, identifying themselves as Waterman Financial Group HR representatives and accusing him of check fraud.
They also allegedly threatened to issue a warrant for his arrest and take him to jail as well as garnish his social security and disability. The consumer added that collectors called his mother, sister, and girlfriend and told them that if he didn’t pay the debt, he would be sued and could face five to 10 years in prison.
Feeling harassed by Waterman Financial Group, LLC, the consumer fought back by suing the agency for:
- Using harassing and abusive means to collect a debt
- Harassing him by phone
- Using unfair and unconscionable means to collect a debt
- Failing to identify itself as a debt collector in all communications
- Threatening actions it could not legally take
- Refusing to validate the debt on request
A judge awarded the consumer $6,500 in statutory damages, plus court costs and attorney fees.
