Are You Being Called By USCB Corporation?*

Do you feel that you are being treated unfairly or even harassed by debt collectors? Are you suspicious about the validity of their claims or stressed by their collection tactics? Make sure that you know your rights and that there are laws in place to make these agencies respect them.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, protects you from aggressive, deceptive, and unfair debt collection practices. If a collection agency tries to compel you to pay by using threats or intimidation, you can file a complaint against them.

Examples of illegal collection tactics include:

  • Using profane and obscene language
  • Using the telephone to harass you with constant calls
  • Failing to report to the credit bureaus that a debt is in dispute
  • Refusing or failing to validate the debt and prove that they are authorized to collect it
  • Ignoring a formal cease communications request
  • Calling you before 8:00 a.m. and after 9:00 p.m. in your time zone

Alleged Violations against USCB Corporation

According to PACER, on or about January 15, 2013 USCB Corporation allegedly sent a collection letter to a Colorado consumer seeking payment for a student loan debt.

She called the agency to dispute the debt, saying she never borrowed that much, but the representative allegedly told her that the dispute had to be in writing. The consumer sent a dispute letter, but when she checked her credit report later, the company had not reported the account as disputed.

Feeling harassed by USCB Corporation, she hired a consumer and sued the agency for violating the FDCPA by:

  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
