Is Turning Point Solutions Calling You?*

People fall into serious debt for a number of understandable reasons, such as illness, job loss, or an unexpected and necessary expense. Once an account is delinquent, creditors will usually assign them to third-party debt collectors who can make your situation even worse if you don’t know your rights.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA), which is enforced by the Federal Trade Commission, governs what third-party debt collectors can do while attempting to collect consumer debts. Actions like the following are strictly prohibited:

  • Using profane or obscene language
  • Making threats they cannot legally carry out or have no intention of carrying out
  • Discussing your debt with anyone except you, your spouse, or your attorney
  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m.
  • Claiming to be police officials or government agents
  • Using an autodialer to harass you by phone

Alleged Violations against Turning Point Solutions

Janice Lavrich vs. Turning Point Solutions*

According to PACER, in or around December 2014, Turning Point Solutions contacted Ohio resident Janice Lavrich in an attempt to collect a debt that allegedly was not hers. She explained to the callers that they had the wrong number and requested that contact cease, but the calls allegedly continued.

Feeling harassed by Turning Point Solutions, Ms. Lavrich hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Using harassing and abusive means to collect a debt
  • Harassing her by phone
  • Using unfair and unconscionable means to collect a debt
  • Ignoring a cease communications request

A judge later ordered Turning Point Solutions to pay Ms. Lavrich $6,000 in actual and statutory damages.
