Is TSYS Total Debt Management Inc calling you? Here’s what you need to know.
When you’re in heavy debt, the resulting stress affects other aspects of your life. Even when you succeed in making the minimum monthly payments, there’s a futile sense of owing more than you can ever repay.
If you lose your job or become ill, even the minimum payments may become more than you can handle. Some creditors might work with you, but most will eventually turn your accounts over to a debt collector, who may try to squeeze blood from a stone.
Your Rights Under the FDCPA
The Fair Debt Collection Practices Act, or FDCPA, protects indebted consumers from unethical third-party debt collection practices. Actions like the following are illegal when used to pressure a consumer into paying a debt.
- Using profane or obscene language
- Reporting false information to the credit bureau
- Failing or refusing to identify themselves as debt collectors
- Threatening to have you arrested or imprisoned if you don’t pay
- Calling you at work when your employer does not allow such calls
- Talking about the debt to anyone except you, your spouse, or your attorney

Alleged Violations against TSYS Total Debt Management Inc
Marie Williams vs. TSYS Total Debt Management Inc d/b/a National Attorney Network
On or about August 25, 2008, Illinois resident Marie Williams was served with a summons and complaint in a lawsuit filed in the Circuit Court of Cook County, Illinois for the purpose of collecting a purported credit card debt. TSYS Total Debt Management Inc had been hired by Capital One Bank to collect the debt and process the litigation.
The paperwork included a summons, complaint, and affidavit of Maisha Davis, who allegedly provided it as an “agent” of Capital One. Ms. Davis was in fact an employee of TSYS Total Debt Management Inc, although the affidavit did not state that fact.
Wondering how a non-employee could possibly testify about Capital One’s records and accounts, Ms. Williams hired a consumer attorney and filed a lawsuit against TSYS Total Debt Management Inc for allegedly violating the FDCPA by using false, deceptive or misleading representations or means to collect the debt.
The matter was later settled.
