According to PACER, on or about May 21, 2014, Troy Capital, LLC sent a collection letter to a Pennsylvania consumer. The letter indicated that interest could continue to accrue on
unpaid principle, which she took as a subtle threat to pay the debt.

The consumer was also concerned because a barcode and account number were visible through a glassine window on the envelope, making her personal information viewable. The letter also did not advise her that a dispute had to be in writing.

Feeling harassed by Troy Capital, LLC, the consumer sued the company for the following alleged FDCPA violations:

  • Making misleading statements about her dispute rights
  • Using false, deceptive, and misleading means to collect a debt
  • Making her account number visible to outside parties

The matter was later settled.
