Are you being called by Thomas & Williams, LLC?* Here’s what you need to know.

When debt collectors are chasing you for accounts you can’t afford to pay off, hearing the phone ring can cause tremendous stress, especially if the company you’re dealing with is regularly hostile, aggressive, and demeaning to you. Before you give serious consideration to bankruptcy, see a consumer attorney instead, because such abusive collection behavior violates federal law.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, requires collection agencies to be professional and adhere to professional codes of conduct when attempting to collect a consumer debt. Using collection methods like those below is illegal and can cause an agency to lose its license.

  • Using abusive and / or obscene language
  • Calling your workplace and mentioning the debt to your co-workers
  • Claiming to be police officers or federal agents
  • Calling you at all hours of the day and night
  • Leaving voice messages that do not identify the collector and the purpose of their call
  • Telling you that you will be arrested for nonpayment

Alleged Violations against Thomas & Williams, LLC

Sandra King vs. Thomas & Williams, LLC et al*

According to PACER, in or around mid-2012, Thomas & Williams, LLC allegedly began to contact Louisiana resident Sandra King about an alleged debt. She later complained that firm representatives called her at her workplace despite an employer ban on such communications, and even discussed her debt with a co-worker. Ms. King also alleged that the calls were numerous enough to constitute harassment, and many voice messages did not identify the caller as a debt collector.

Feeling harassed by Thomas & Williams, LLC, she hired a consumer attorney and sued the company for allegedly violating the FDCPA in the ways outlined below:

  • Using false, deceptive, and misleading means to collect a debt
  • Discussing the debt with uninvolved third parties
  • Using unfair and unconscionable means to collect a debt
  • Calling her at work even after being advised that such calls were not permitted
  • Harassing her by phone
  • Failing to send a validation letter five days after initial contact

The matter was later settled.
