Sue Schertz vs. T-H Professional & Medical Collections, Ltd. et al*

According to PACER, on or around December 9, 2013, Illinois resident Sue Schertz received a debt collection letter from T-H Professional & Medical Collections, Ltd.. She contacted the agency and paid them the amount indicated on the letter.

During this conversation, the representative allegedly notified Ms. Schertz of other debts she owed and agreed to send the information in writing.

Ms. Schertz later claimed that despite agreeing to a payment plan, she never received any correspondence about these additional debts. So around January 2014, she contacted T-H Professional & Medical Collections, Ltd. and told them not to take the payment agreed upon out of her account because she had not received any written communication regarding the additional debts.

The representative told her the information had been sent, but agreed to send it again. When the information arrived, some of the debts were allegedly 7-10 years old.

Soon afterwards, T-H Professional & Medical Collections, Ltd.called Ms. Schertz at home regarding these debts. During this conversation, she said she was on Social Security Disability and was terminally ill and could only make small payments.The collector allegedly responded that everyone is going to die sooner or later and threatened to garnish her husband’s wages if she did not pay the debt.

Feeling harassed by T-H Professional & Medical Collections, Ltd., Ms. Schertz hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Using false, deceptive, and misleading means to collect a debt
  • Using abusive and harassing methods to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later dismissed.
