Many consumers are contacted by debt collectors to an extent that they find alarming and harassing. They receive letters that demand payment during the statutory dispute period and embarrassing calls at work.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, gives legal protection to consumers who are dealing with third-party debt collectors. It grants you the right to order the collector to stop calling you and take legal action against agencies that abuse your rights in the following ways:

  • Calling you before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Calling you abusive names over the phone and in voice mails
  • Trying to convince you that you’ll be arrested and jailed if you don’t pay
  • Inflating the amount of the original debt with illegal collection fees
  • Calling your friends and family and telling them that you owe money
  • Pretending to be attorneys or federal agents
