When debt collectors get you on the line, they may use any number of ruses to get you to pay the debt. Some tactics are legal, such as calling you within approved hours, but others are examples of extreme harassment. Here’s what you need to know.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, protected indebted consumers by mandating that third-party debt collectors may not use methods like those below to collect debt payments from you.

  • Using abusive and / or obscene language
  • Claiming to be police officers or federal agents
  • Leaving voice messages that do not identify the collector and the purpose of their call
  • Calling you at work when they know that your employer prohibits such calls
  • Calling at unreasonable and inconvenient times, such as before 8:00 a.m. or after 9:00 p.m. in your time zone
  • Threatening legal actions that they have no intention of taking

According to information on the PACER website, in or around early 2009, Superior Asset Management began calling a California consumer. She insisted that she was not the party they were looking for and to stop calling, but the company allegedly continued to call.
