According to PACER, on or about November 21, 2017, Sortis Financial, Inc. (at the time doing business as Clear Springs Loan Services) sent a collection letter to an Arizona couple. It demanded payment for an outstanding balance on a property that had been foreclosed upon in 2005.

The Judgment in the case had expired as of January 12, 2017, making it no longer owed or collectible, but the couple continued to receive monthly demands.

Feeling harassed by Sortis Financial, Inc., they filed an FDCPA lawsuit against the agency for the following illegal collection activities:

  • Misrepresenting the legal status of the debt
  • Using false, deceptive, and misleading means to collect a debt

The matter was later settled.
