According to PACER, on or around January 28, 2013, RSH & Associates, LLC called a Missouri consumer and allegedly threatened to take legal action against her if she didn’t pay the debt.
She claimed that the caller did not identify himself as a debt collector and that she never received a validation letter within five days of this initial contact. The consumer also alleged that debt collectors called her at work, causing her embarrassment.
In July 2013 she engaged an attorney who sent RSH & Associates, LLC a cease communications notice but a debt collector allegedly called her on August 26 and told her that he was aware she had an attorney but had better pay her debt anyway.
Feeling harassed by RSH & Associates, LLC, the consumer sued the agency for allegedly violating her rights by:
- Failing to send her a debt validation letter
- Failing to identify itself as a debt collector in all communications
- Calling her at work after being asked to stop
- Using false, deceptive, and misleading means to collect a debt
- Contacting her directly although she had an attorney
The matter was later dismissed.
