Are You Being Called By Red River Collection Company, Inc.?*

Debt collectors have a reputation for using unfair and unconscionable pressure tactics to make debtors pay. Every year, consumer watchdog groups receive complaints about collection agencies shouting at people, embarrassing them at home and work, and making legal threats that cause stress and sleepless nights. None of these behaviors are legal, however.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a federal statute that dictates where, when, and how a third-party debt collector can contact you and request payment. If you’re dealing with a collection agency that subjects you to these types of abuses, talk to a consumer lawyer to discuss your next step.

  • Calling you outside the hours of 8:00 a.m to 9:00 p.m. in your time zone
  • Demanding that you pay a debt that is legally time-barred
  • Intentionally reporting inaccurate information to the credit bureaus
  • Calling you a deadbeat or loser
  • Calling your relatives and friends about the debt
  • Adding illegal service fees to the debt total

Alleged Violations against Red River Collection Company, Inc.

According to PACER, in or around October 2013, Red River Collection Company, Inc. started contacting a Colorado consumer to collect a debt. On or around November 11, 2013, she spoke with a female representative named “Jody Lucero” and requested that all calls to her workplace cease, but a dozen more calls allegedly followed.

When the consumer insisted that she could not afford to pay, “Jody” allegedly replied that since she has a job and is making money, Red River Collection Company, Inc. would simply take the money out of her paychecks.

Feeling harassed by Red River Collection Company, Inc., the consumer hired an attorney and sued the agency for allegedly violating the FDCPA in the following ways:

  • Using harassing and abusive means to collect a debt
  • Harassing her by phone
  • Calling at work although such calls were prohibited by the employer
  • Using false, deceptive, and misleading means to collect a debt
  • Using unfair and unconscionable means to collect a debt

The matter was later settled.
