Are you being called by RC Services, Inc.?* Here’s what you need to know

The Consumer Financial Protection Bureau constantly receives complaints about debt collectors and their alleged misconduct. Some consumers complain of being threatened while others claim that they are being asked to pay someone else’s debt. If you find yourself in such a situation, know your rights.

Your Rights Under the FDCPA

In 1977 Congress passed the Fair Debt Collection Practices Act, or FDCPA, which set guidelines for third-party collection agency conduct and prohibited them from using harassing or deceptive tactics to collect a consumer debt.

  • Calling you constantly every day
  • Pretending to be police officers, government officials, or any other law enforcement figure
  • Demanding amounts not supported by law or the original creditor agreement
  • Disguising the fact that they are debt collectors trying to collect a debt
  • Using profane and obscene language
  • Reporting false information to the credit bureaus

Alleged Violations against RC Services, Inc.

According to PACER, a Washington resident gave RC Services, Inc. a series of postdated checks to cover his daughter’s debt. The first one was scheduled to be cashed on May 6, 2004, but the company allegedly deposited it on May 3, causing his account to become overdrawn.

Feeling harassed by RC Services, Inc., he hired a consumer attorney and sued the company for allegedly violating the FDCPA by using unfair and unconscionable means to collect a debt.
The matter was later dismissed.
