Are You Being Called By Ray Klein, Inc.?*

No matter how much you owe, collection agencies are supposed to treat you with dignity and respect. This isn’t the reality, however: newspaper headlines proclaim stories of consumers being driven to bankruptcy and even suicide by debt collectors.

If a company becomes too aggressive with you, see a consumer lawyer who can help you protect your rights.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, is a federal consumer protection law that prohibits third-party debt collectors from treating you in unfair and unethical manners. If you are being subjected to any of these abuses, the law gives you the standing to fight back and seek compensation.

  • Swearing and using profane language
  • Calling at all hours of the day and night
  • Refusal to provide you with information about the debt
  • Discussing the debt with your family and friends
  • Threatening to have you arrested for nonpayment of the debt
  • Leaving vague messages that do not identify them as debt collectors

Alleged Violations against Ray Klein, Inc.

According to PACER, on or about February 25, 2013, Ray Klein, Inc. began calling a Colorado consumer to collect a debt. During a phone conversation that allegedly took place on that day, the consumer stated that he disputed the debt but when he checked his credit report later, the account was not noted as disputed.

Feeling harassed by Ray Klein, Inc., the consumer obtained a lawyer and sued the agency for allegedly violating his rights by:

  • Using unfair and unconscionable means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Failing to report the debt as disputed to the credit bureaus

The matter was later dismissed.

Can Ray Klein legally take money from your bank account? I was under the impression that any type of garnishment was to be taken BEFORE hand and not directly from your bank account. Not even sure how he got my account info to do this since I have had to close my old account and open a new one due to fraudulent activity.
