Are You Being Called By Rawlings Financial Services, LLC?*

Are you being called by Rawlings Financial Services, LLC?* Here’s what you need to know.

Is a debt collector calling you every day yelling and demanding that you pay now or risk losing your house or even your freedom? If so, they are violating federal law law, and if you file a claim against them, you could be awarded even more money than you allegedly owed in the first place.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, was passed in 1977 to protect indebted consumers from abusive debt collection methods. Any collection agency that uses unethical tactics like the following can potentially have their license revoked or be fined thousands of dollars.

  • Swearing, yelling, and calling you names
  • Contacting you after you have sent a cease and desist letter
  • Calling you before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Using an autodialer to leave a series of prerecorded messages
  • Failing to identify themselves as debt collectors trying to collect a debt
  • Calling you at work after you tell them that you can’t take personal calls there

Alleged Violations against Rawlings Financial Services, LLC

According to PACER, on or about February 8, 2011, Rawlings Financial Services, LLC sent a collection letter to a North Carolina resident to collect a medical debt owed by her deceased husband.

On or about February 15, her attorney called Rawlings in reference to the account and spoke to “Ron” and informed him of the representation. This call was followed by another call and a fax, but on about March 29, 2011, Rawlings allegedly sent another collection letter directly to the consumer.

Feeling harassed by Rawlings Financial Services, LLC , she hired a consumer attorney and sued the company for allegedly violating the FDCPA by contacting her directly although she had legal representation.

The matter was later dismissed.
