Are You Being Called By Quantum Collections?*

Financial problems can be difficult to manage. Add persistent contact from a collection agency and a difficult situation becomes even harder to resolve. Fortunately, the Fair Debt Collection Practices Act (FDCPA) protects consumers from unethical and / or harassing third-party debt collection practices.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act (FDCPA) governs debt collection methods. It prohibits collection agents from using deceptive, unfair, or abusive methods to convince you to pay a debt. Examples include:

  • Calling at inconvenient times, usually before 8:00 a.m., after 9:00 p.m. in your time zone
  • Discussing the debt with anyone but you, your spouse, or attorney
  • Threatening you with violence, arrest, or imprisonment if they don’t pay
  • Calling you repeatedly at work after you indicate that you are not permitted to take such calls.
  • Swearing or using abusive language
  • Failing or refuse to provide verification of the debt

Company Profile: Quantum Collections

If you are being called by Quantum Collections, information about the company is below.

Quantum Collections is a debt collection company located in Las Vegas, Nevada. It was established in 1979, has approximately 40 employees, and is managed by Erik J Nielsen. A review of consumer-filed lawsuits indexed and digitized at the PACER (Public Access to Court Electronic Records) website confirms that people who felt they were being harassed by Quantum Collections fought back with compensation demands of their own.

Alleged Violations against Quantum Collections

According to PACER, in or around early 2012, Quantum Collections began contacting a Nevada resident about an alleged debt. He later asserted that collectors called him at his place of employment and did not stop, even after he advised that such calls violated workplace policy. He also complained that Quantum collectors used bullying tactics with him, speaking to him in a loud and aggressive tone and accusing him of lying.

Feeling harassed by Quantum Collections, he hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Calling him at work in violation of workplace policy
  • Using harassing and abusive means to collect a debt
  • Using profane and abusive language

The matter was later dismissed.

Abusing consumers in this manner is illegal, and if you file a claim against Quantum Collections, you could potentially be awarded $1,000 per FDCPA violation. Let your attorney help you get the compensation you deserve.
