It was founded in 2007, employs 25 people, and is managed by Bryan K. Faliero. It outsources purchased debts to Resurgent Capital Services for collection. An inspection of civil litigation records at the PACER website suggests that consumers who believed they were being harassed by PYOD, LLC filed lawsuits to hold the company accountable.

Alleged Violations against PYOD, LLC

According to PACER, on or around January 3, 2018, PYOD, LLC allegedly sent a collection letter to a Texas consumer through an agent. It stated, in part:

The law limits how long you can be sued on a debt. Because of the age of your debt, PYOD LLC will not sue you for it and PYOD LLC will not report it to any credit reporting agency.

Notwithstanding the fact that the debt was time-barred, PYOD, LLC requested payment for it and even offered payment arrangements.

Feeling harassed by PYOD, LLC, the consumer hired a consumer attorney and sued the company for the following alleged FDCPA violations:

  • Using false, deceptive, and misleading means to collect a debt
  • Misrepresenting the legal status of the debt
  • Threatening legal action not intended to be taken

The matter was later dismissed.
