Are You Being Called By Global Recovery Group, LLC?*

Are you being called by Global Recovery Group, LLC?* Here’s what you need to know

Debt collectors are widely despised for a number of reasons. Although there are plenty of companies that observe the law, consumers frequently post reports of collection agencies using pressure tactics to scare consumers into paying. All of these actions are illegal when used to collect a debt.

Your Rights Under the FDCPA

Before the Fair Debt Collection Practices Act, or FDCPA, was passed in 1977 to protect consumers from unethical debt collectors, tactics like the following were routine. Now using them can get a collection agency shut down permanently.

  • Failing to identify themselves during each communication as a debt collector seeking to collect a debt
  • Pretending to be police officers, government officials, or any other law enforcement figure
  • Using obscene, profane, and threatening language
  • Calling the consumer at work after being informed that the workplace does not allow non-business calls
  • Telling the debtor’s friends, neighbors, and uninvolved family members about the debt
  • Failing or refusing to validate the debt

Alleged Violations against Global Recovery Group, LLC

According to PACER, in or around mid-December 2013, Global Recovery Group, LLC contacted the sister of a California resident in an attempt to collect a consumer debt. He later claimed that collectors left a message on her voicemail system stating that there was a claim against him.

When the plaintiff called to investigate, Global Recovery Group, LLC allegedly refused to disclose any information until he provided his credit card information and agreed to state that he had received a letter in the mail from the company. When he finally provided his credit card details, the company allegedly informed him that the alleged debt originated from a “Checks into Cash” Payday Loan from 2010, which he believed he had already paid.

The plaintiff claimed that Global Recovery Group, LLC allegedly told him that he must make an immediate payment on the alleged debt or they would bring criminal charges against him for fraud. Upon concluding the conversation, he canceled his credit card to avoid any fraudulent charges.

Feeling harassed by Global Recovery Group, LLC, he hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Failing to send a debt validation letter after the first communication
  • Contacting him at inconvenient places and times
  • Using false, deceptive and misleading means to collect a debt
  • Using harassing and abusive means to collect a debt
  • Contact an unauthorized third party about the debt

The matter was later dismissed.
