Is Global Payments Check Services, Inc. Calling You?*

Are you being woken up by debt collectors early in the morning and late at night? Are you afraid to answer your phone or check your mail? If collection agency misconduct is hurting your life to this extent, it’s time to learn more about the laws that affect debt collectors and how they protect you from these situations?

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, specifies how and when a third-party debt collector can contact you. When you don’t want any more calls or letters, you can order a company to stop communicating with you.

If they ignore your request or subject you to abuses like those below, you can sue.

  • Threatening you and your loved ones with physical violence
  • Re-aging a debt to make it appear to be still collectible
  • Making threats that they cannot legally carry out
  • Using obscene language
  • Refusing to prove that they are authorized to collect the debt
  • Calling you at work after being asked to stop

Alleged Violations against Global Payments Check Services, Inc.

According to PACER, in or around October 2017, Global Payments Check Services, Inc. started trying to collect a credit card debt from an Illinois consumer.

He complained that he started receiving calls on his cell phone that appeared to be made by an autodialer: when he answered, there was a noticeable pause, lasting several seconds in length, before being connected to a live representative.

The consumer told the callers that he didn’t owe them any money and to stop calling, but the unwanted communications allegedly continued.

Feeling harassed by Global Payments Check Services, Inc., he engaged the services of a consumer lawyer and sued the agency for allegedly violating his rights by:

  • Using harassing and abusive means to collect a debt
  • Calling him by using an autodialer
  • Continuing to call after being asked to stop

The matter was later dismissed.
