Receiving daily phone calls and letters that threaten lawsuits and other consequences is alarming and stressful. You want it to stop, but the debt collector ignores your cease communications letters and says they won’t stop contacting you until you pay.

Don’t tolerate, as legal counsel is more accessible than you think.

Your Rights Under the FDCPA

Under the Fair Debt Collection Practices Act (FDCPA), indebted consumers are entitled to protection against abuse, deceit, harassment and other forms of unfair treatment from third-party collection agencies. If you are subjected to any of the following, your rights have been violated and you can sue.

  • Contacting you at work despite knowing that personal calls are not allowed there
  • Failing or refusing to identify themselves as debt collectors trying to collect a debt
  • Contacting you after you have formally requested that all communications cease
  • Pretending to be police officers, government officials, or any other law enforcement figure
  • Calling at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m. in your time zone
