Financial problems are a huge source of stress, especially if you’ve reached the point where your creditors have turned your accounts over to third-party debt collectors or charged them off and sold them to junk debt buyers.

Collection calls and notices will soon follow, and not all debt collectors choose to conduct themselves professionally.

It’s easy to forget that you have rights when a rude and aggressive collection agent is pestering you day and night, but the Fair Debt Collection Practices Act, or FDCPA, was passed in 1977 to regulate the way that third-party collection agencies communicate with consumers.

You don’t have to put up with harassing tactics and aggressive demands from debt collectors, and the FDCPA grants you the legal right to seek compensation.

Among other things, it prohibits the use of unprofessional and harassing collection tactics like the following:

  • Calling before 8:00 a.m. and after 9:00 p.m. in your time zone
  • Calling you at work after being told that such calls are prohibited by the employer
  • Failing to identify themselves as debt collectors trying to collect a debt
  • Making threats that they have no intention of following up on, such as sending you to jail or getting a judgement against you
  • Telling uninvolved third parties that they are trying to collect money from you
  • Charging excessive fees that inflate the original debt to an amount not supported by law
  • Using profane, or obscene language

Although unethical and illegal, these actions remain in use today because too many consumers are unaware of their rights under the FDCPA. Don’t let yourself be one of them.

Alleged Violations against Fresno Credit Bureau*

Fresno Credit Bureau is a collection agency located in Fresno, California. It was established in 1935, employs 20 to 49 employees, and is a member of American Collectors Association International and the California Association of Collectors.

A review of records archived at the PACER (Public Access to Court Electronic Records) website indicate that Fresno Credit Bureau has been accused of violating the FDCPA during its debt collection attempts.

On or around February 1, 2015, a California resident received a phone call from attorney John D. Suhr about a debt she had allegedly defaulted on. She later claimed that Mr. Suhr failed to disclose that he was a debt collector.

Later that month, or about February 26, 2015, Fresno Credit Bureau agents called the plaintiff and spoke with her regarding the debt, allegedly without first identifying themselves as debt collectors.

Within the next two days she received repeated calls from both the agency and Mr. Suhr, and each communication was allegedly not preceded by a ‘mini-Miranda’.

The plaintiff filed a complaint accusing Fresno Credit Bureau of failing to disclose that all communications were from a debt collector, in violation of the law/p>

The matter was later settled.

The phone numbers for Fresno Credit Bureau are 1-559-485-7900 and 1-877-485-7940. If either number appears on your caller ID, a debt collector may be trying to contact you about a delinquent debt.

If they fail to identify their purpose and the company they work for in each communication, see a consumer attorney. The FDCPA requires collectors to be completely transparent when attempting to collect a debt from you, and failure to do so is against the law.

If you opt to sue Fresno Credit Bureau, you could potentially win $1,000 per FDCPA violation, as well as court costs and attorney fees. Collecting a debt is legal, but deceiving you is not, and could be a costly error for an unethical debt collector.
