According to PACER, on or around March 10, 2014, FirstPoint Collection Resources, Inc. sent a collection letter to a North Carolina resident to collect a medical debt.

The letter added, “A $3.00 CONVENIENCE CHARGE WILL BE ADDED TO YOUR PAYMENT IF USING A CREDIT CARD.” Feeling harassed by FirstPoint Collection Resources, Inc., the plaintiff hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Charging a convenience fee for debt payments
  • Using false, deceptive and misleading means to collect a debt
  • Using abusive and harassing means to collect a debt

The matter was later dismissed.
