Alleged Violations against FCI Lender Services, Inc.

According to PACER, on or around July 14, 2015, FCI Lender Services, Inc. sent a Florida consumer a mortgage statement showing that he owed $3,057.61, although he had sent a $3,000 check that had been subsequently cashed.

This communication was also sent directly to him although he had an attorney representing him.

Feeling harassed by FCI Lender Services, Inc., the consumer sued for the company for the following alleged FDCPA violations:

  • Contacting him directly when he was represented by an attorney regarding the debt
  • Using false, deceptive, and misleading means to collect a debt
  • Misrepresenting the character, amount, or legal status of the debt
  • Using unfair and unconscionable means to collect a debt

The matter was later dismissed.
