Alleged Violations against FCC Finance
According to PACER, in or around April 2011, FCC Finance began calling a Tennessee couple to collect a debt. They complained that they sometimes received up to four calls a day and that one call came in after 9:00 p.m. The wife alleged that collectors called her at work, accused her of trying to avoid her debt responsibilities, and threatened to sue her.
The consumers said that on November 14, 2011, a female collector came to their home, took pictures of their property, and handed them an ‘Urgent Notice’ regarding the debt. This was allegedly the first written communication they had received since the agency started contacting them the previous April.
Feeling harassed by FCC Finance, the consumers sued the company for:
● Harassing them by phone
● Threatening legal action it did not intend to take
● Using deceptive means to collect a debt
● Using unfair and unconscionable means to collect a debt
● Failing to validate the debt within five days of initial contact
The matter was later resolved.
