Continental Collection Agency Ltd is a collection agency located in Denver, Colorado. It was founded in 1991, has 10 to 19 employees, and is managed by Angel Spivak. A review of files archived at the PACER (Public Access to Court Electronic Records) website indicates that Continental Collection Agency Ltd has been sued for allegedly violating consumer rights while attempting to collect a debt.

Lain Graves vs. Continental Collection Agency Ltd

According to PACER**, prior to 2005, a Colorado resident Lain Graves amassed a debt of $1500 to Pine Creek Village Apartments, which subsequently went into default and was assigned to Continental Collection Agency Ltd for collection.

The agency contacted her in an attempt to collect the debt. He had filed for bankruptcy in 2005, and the debt was discharged in the filing on or about February 23, 2006. Nonetheless, Continental Collection Agency Ltd served him with a summons and complaint, in an attempt to collect the debt. She emailed a copy of his bankruptcy papers to the agency’s lawyer and was allegedly told that the information was received but they “do not care.”

Continental Collection Agency Ltd proceeded with the court case and in January 17, 2012 and were granted a default judgment in their favor against her. He later complained that he had attempted to contact the company many times, but they refused to speak with him, said they do not care, hung up on him, and did not return his calls.

When, on February 29, 2012, Continental Collection Agency Ltd began garnishing his paychecks, Mr. Graves hired a consumer attorney and filed a lawsuit accusing the agency of violating the FDCPA in the following ways:

  • Engaging in behavior that harassed, oppressed, or abused him
  • Misrepresenting the character, amount and legal status of the debt
  • Using false and deceptive means to collect a debt.

The matter was later settled.
