Are You Being Called By Complete Payment Recovery Services*? Here’s What You Need to Know

For thousands of consumers, life is a daily struggle because debt collectors will not leave them alone. They receive harassing phone calls at all times of the day and night and even at work. Although a collection agency may tell you that they have the right to harass you until you pay them, the truth is otherwise.

Your Rights Under the FDCPA

The Fair Debt Collection Practices Act, or FDCPA, has been protecting the rights of indebted consumers for over 40 years. If a third-party collection agency uses these types of pressure tactics to make you pay a debt, they are breaking the law.

  • Trying to collect a debt discharged in bankruptcy
  • Communicate negative information to the credit bureaus to cause trouble
  • Calling you at work although such calls were prohibited by your employer
  • Shouting and swearing at you over the phone
  • Threatening legal actions it has no intention of taking, such as serving you at work
  • Calling you outside the hours of 8:00 a.m to 9:00 p.m. in your time zone

Alleged Violations against Complete Payment Recovery Services**

According to PACER, on or around July 2012, Complete Payment Recovery Services started calling a Maryland consumer to collect a debt. He complained that he received calls on his cell phone nearly every day, sometimes three to four times a day. Each time he answered the phone, he allegedly got a recorded message. He also alleged that he had never received a debt validation package from the company.

Feeling harassed by Complete Payment Recovery Services, the consumer sued the company for allegedly violating his rights by:

  • Using an autodialer to call him
  • Using harassing and abusive means to collect a debt
  • Using unfair and unconscionable means to collect a debt
  • Failing to send a debt validation letter

The matter was later settled.
