Alleged Violations against CheckRedi of Kentucky, LLC

According to PACER, on or about June 30 and July 3, 2014, CheckRedi of Kentucky, LLC allegedly made unauthorized withdrawals from a consumer’s bank account in an attempt to collect a debt, which caused her to incur overdraft fees totaling $140.00.

She later claimed that she never provided her bank account information to the company and never provided her consent to withdraw money from her account.

She also alleged that on or about August 6, 2014, CheckRedi of Kentucky, LLC left a voicemail that failed to identify it as a debt collector and failed to send her written correspondence regarding her right to dispute the Debt.

Feeling harassed by CheckRedi of Kentucky, LLC, the consumer sued the agency for allegedly violating her rights under the FDCPA by:

  • Using harassing and abusive means to collect a debt
  • Failing to identify itself as a debt collector in all communicationst
  • Using false, deceptive, and misleading means to collect a debtt
  • Using unfair and unconscionable means to collect a debtt

The matter was later settled.
