According to PACER, in early March 2012, a Georgia resident received a voice message from Chebat Financial Group, LLC. The caller allegedly stated that she was a courier or process server that was in his area and wanted to make arrangements to meet personally with him in order to deliver legal papers, namely a “certified notice of intent”. She allegedly added that this was his “final notification,” and that if he refused to sign for the document that it would have adverse consequences.

When he called the number provided, he spoke to a representative who allegedly threatened that suit would be filed if he did not pay by the end of the day and that papers would be served on him at work.

Feeling harassed by Chebat Financial Group, LLC, the Georgia resident hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:
