Are You Being Called By CFM Group, LLC?*

When a collection agency is on your trail, it can be relentless. Its agents will call relatives you haven’t spoken to in years, pretend to be FBI agents with an arrest warrant out for you, and even call your payroll department at work to advise that a garnishment order may be forthcoming.

This is all illegal conduct that can get the agency in trouble if you act on your rights.

Your Rights Under the FDCPA

The Fair Debt Collections Practices Act (FDCPA) is a consumer protection law that governs the activities of third-party debt collectors. If a collection agency tries to stress you into paying by using the following actions, it is breaking federal law.

  • Calling you before 8:00 a.m. and after 9:00 p.m. your time
  • Disguising the fact that they are debt collectors trying to collect a debt
  • Refusing or failing the validate the debt
  • Demanding amounts that exceed the amount of the original debt
  • Using profane or obscene language
  • Calling you at work if they know that your employer does not permit such calls

  • Using harassing and abusive means to collect a debt
  • Using false, deceptive, and misleading means to collect a debt
  • Failing to identify itself as a debt collector in all communications
  • Failing to send her a debt validation notice
  • Using unfair and unconscionable means to collect a debt

The matter was later dismissed.
