A close examination of records archived at the PACER (Public Access to Court Electronic Records) website confirms that consumers who believed they were being harassed by Bayview Solutions, LLC refused to yield to pressure and pay.

Alleged Violations against Bayview Solutions, LLC

According to PACER, in or around early 2016, Bayview Solutions, LLC started trying to collect a debt from a Washington resident. He later alleged that during these collection attempts, the company threatened to sue him, leaving voicemails stating that it would be “seeking litigation” and “move forward with legal documents”.

The Washington resident also complained that collectors failed to identify themselves as such in each email and did not send him debt validation when asked. Feeling harassed by Bayview Solutions, LLC, the Washington resident hired a consumer attorney and sued the company for allegedly violating the FDCPA in the following ways:

  • Threatening to take an action or actions that cannot be legally taken
  • Using false, deceptive, and misleading means to collect a debt
  • Failing to send validation of the debt

The matter was later dismissed.
